Summary: Petition for panel rehearing was granted and the original panel decision withdrawn (642 F.3d
1226 (9th Cir. 2011). (You can read the original summary and decision here). In harmonizing its decision with the Court’s recent decision in Perez-Mejia v. Holder, ___ F.3d ___, slip op. 20391 (9th Cir. 2011)(read the summary and decision here), the Court held that petitioner admissions at the “pleading stage” of his immigration proceedings (i.e., master calendar hearing), even if unrepresented by counsel, was sufficient to establish removability for a criminal conviction without corroboration from the record of conviction.
