GARCIA-CALLEJAS V. HOLDER

1st Circuit

Garcia-Callejas v. Holder (1st Circuit, January 24, 2012)

Boudin, Lipez, Howard (per curiam)

Summary:  The First Circuit affirmed the agency’s denial of petitioner’s claim for withholding of removal, finding that petitioner’s alleged social group—El Salvadorian males, who are perceived as wealthy, that resist gang recruit—as not cognizable.  See Mendez-Barrera v. Holder, 602 F.3d 21, 27 (1st Cir. 2010)(rejecting a social group "young women recruited by gang members who resist such recruitment" in El Salvador); Larios v. Holder, 608 F.3d 105, 108-09 (1st Cir. 2010) (rejecting a social group "young Guatemalan men recruited by gang members who resist such recruitment"); Sicaju-Diaz v. Holder, 663 F.3d 1, 4 (1st Cir. 2011) (rejecting a social group based on perceived wealth).
